A 35-year marriage could not withstand a betrayal. According to Dafeng News, a 62-year-old woman surnamed Xu in Shanghai recently discovered that her 67-year-old husband had an extramarital affair with her 50-year-old best friend, Ms. Chen, whom she had known for many years. She was even more shocked to find that the other party had transferred huge sums of money to the mistress privately many times, which made her so angry that she divorced and filed a lawsuit to get back her rights.

This emotional entanglement took place in Pudong, Shanghai. Ms. Xu and her husband surnamed Shen have been married since 1989 and have spent more than 30 years together, but in 2024, they divorced because they found out that her husband had an affair with his best friend. After the divorce, Ms. Xu found out from the bank records that her ex-husband had transferred money to Ms. Chen many times between 2023 and 2024, with a cumulative amount of up to 86,000 yuan. She immediately filed a lawsuit in court to recover half of it.

In court, the ex-husband and Ms. Chen claimed that the transfer was just a loan relationship, and even argued that 40,000 yuan of it was transferred by Ms. Xu’s instructions, but the court found that the truth was not simple. According to the transfer records, Chen actually remitted a total of 186,000 yuan, far exceeding the amount claimed by both parties.

In addition, Xu also provided WeChat records as evidence, showing that Chen and Chen had traveled to Tibet together, and even had a falling out in the five-person girlfriend group “Five Golden Flowers”. Xu accused Chen of interfering in her marriage, and Chen responded with a shocking retort, “Do you deserve to take a photo of yourself peeing?”, which made the whole storm even more intense.

After the trial, the court determined that Chen’s unauthorized disposal of the couple’s property was an invalid gift, and finally ruled in favor of Xu’s request, requiring her ex-husband to return 43,000 yuan, which also brought this emotional and financial dispute to an end.

This case also aroused social concern about the issue of “property boundaries in marriage”. “Dafeng News” pointed out that the judge reminded both parties in the marriage that they have the obligation to be responsible for the family’s finances. If one party privately transfers a large amount of money to a third party, it is very likely to constitute an invalid gift.
