
According to the Procuratorate Daily on June 26, the case of Li Moumou suspected of rape, prosecuted by the Yiyang County Procuratorate of Henan Province, was recently opened for trial. What is unexpected is that Li Moumou’s arrest is related to an obstetrician and gynecologist in a local hospital.
In February this year, the Yiyang County Public Security Bureau received a report from the doctor, saying that when he examined a 13-year-old girl, he found that the girl was pregnant and suspected of being sexually assaulted. The public security organs reported this clue to the Yiyang County Procuratorate, which immediately intervened in accordance with the law, cooperated with public security personnel to conduct investigations and launched a “one-stop” protection mechanism, and conducted inquiries, inspections and other evidence collection work on the minors involved in the case at one time. Through questioning, the suspect Li Moumou was initially identified.
“In recent years, although the implementation of the mandatory reporting system has achieved certain results, we have found in the case handling that some departments still have problems such as failure to report and underreporting.” Lv Canguo, deputy chief prosecutor of the Yiyang County Procuratorate in charge of juvenile prosecution, told reporters that in order to promote the implementation of the mandatory reporting system, the procuratorate has established a “must investigate every case” work mechanism for cases involving minors, requiring prosecutors to conduct a retrospective investigation of the implementation of the mandatory reporting system in the process of handling cases involving minors, and confirm whether there are problems such as failure to report.
In handling the rape case of Guo Moumou, the Yiyang County Procuratorate found through retrospective investigation that the teachers of the school involved did not report to the competent department or the public security organs after discovering that the students were sexually assaulted, and only criticized and educated the parties involved. The procuratorate urged the education department to include the implementation of the mandatory reporting system in the school’s annual assessment and regular reporting by issuing procuratorial recommendations. The education department held the teachers involved accountable and organized all teachers to carry out special training and learning on the mandatory reporting system.
In order to eliminate the concerns of reporters and ensure the implementation of the system, the Yiyang County Procuratorate also urged the competent departments of the industry, the public security organs, the courts, etc. to keep the information of the reporters confidential. In June 2024, the procuratorate took the initiative to report to the party committee and promoted the county people’s congress standing committee to issue the “Decision on Strengthening the Implementation of the Mandatory Reporting System for Cases of Infringement on Minors”, and promoted the county party committee’s political and legal committee to take the lead in establishing a joint meeting system for mandatory reporting of cases of infringement on minors, requiring 10 units and departments including the county supervision committee, public security bureau, health and health commission, and education and sports bureau to clarify their responsibilities, cooperate with each other, and jointly escort the healthy growth of minors.
